Chipata Police Arrest 3 in K108, 000 Theft

Police in Chipata have arrested three suspects in connection with the theft of K108 000 at the second class trading area popularly known as Down Shops.

Outgoing Eastern Province Commissioner of Police Alex Chilufya named those arrested as Chris Mbewe 38, Edward Phiri 41 and Chris Banda 29.

Chilufya said the suspects are alleged to have broken into a shop belonging to Younus Suleiman between 22:00 hours on Monday and 05:00 hours on Tuesday.

He said the criminals managed to break the safe box and stole cash amounting to K108 000.

Chilufya said the entry and exit to the shop was accessed through the back wall adding that criminals used unknown explosives to break it.

He said police have managed to recover some household goods and some money from the suspects.

Meanwhile, Police have launched a manhunt for Nebert Sakala for allegedly being in possession of counterfeit notes.

Chilufya said Sakala went to Cavmont Bank Chipata branch to transact and had in possession forged bank notes amounting to K5 100 and that the matter was later reported to the police by Kalulu Kapalu 36 the Bank Manager.

He said a docket has since been opened.

Chiengi Man Dies after House Catches Fire

A 21 year old man of Chiengi of Luapula Province has died while another is nursing injuries after the house they were sleeping caught fire.

Police Spokesperson Esther Katongo said the incident happened when sister to the deceased identified as Suzan Chabu, 35, was frying relish which led to cooking oil spilling on the fire that resulted in a huge flame.

Katongo said the flames immediately spread through the grass thatched house leaving the deceased with severe burns after he attempted to rescue the sister who had been engulfed in the fire but got trapped.

The two victims of the Democratic Republic of Congo origins were rushed to Chiengi District Hospital where the deceased died of severe burns.

The deceased identified as John Mwakwa, a DRC national.

Katongo said 35 year old Suzan Chabu who is seven months pregnant is still admitted in Chiengi District Hospital while the body of the deceased is lying in the same hospital mortuary.

Former U20 Coach Chilombo Dies

Former Under-20 National Team coach and Chipolopolo defender Hector Chilombo has died.

Chilombo died in the early hours of Thursday at the University Teaching Hospital where he had been admitted from Saturday.

The former Zambia international defender held several coaching jobs on the local front among them at Power Dynamos, City of Lusaka, Nchanga Rangers, Napsa Stars, Zanaco, Chilanga Heroes and Lumwana Radiants.

Chilombo led the Zambia Under-20 team to the 2015 Africa Cup of Nations in Senegal.

He played for the Zambia national team in the post Gabon era and won the 1997 Cosafa championship.

Chilombo was part of the Chipolopolo squad that competed in qualifiers for the 1998 France World Cup.

UPND Cadres Arrested for Pulling Down PF Posters in Sesheke

24TH JANUARY, 2019 – Around 13:00 hours Wednesday 23rd January, 2019, Police in Sesheke received a report that suspected UPND supporters were removing campaign materials for their opponents.

When Police made a follow up of the report, they apprehended five people among them four men and one woman and also recovered improvised shot buttons (offensive weapons) from a Land cruiser which was being used by the UPND team.

UPND cadres later went to the Police Station to find out why their colleagues had been arrested and on their way back they blocked the road with stones which they picked from a construction site which is located near their camp.

Order was restored after Police officers rushed to the scene.

So far, the campaigns have been going on well in Sesheke as there has been no clashes recorded between participating political parties.

We however appeal to all Political Parties to adhere to electoral Laws and always preach messages of peace.

All participating Political Parties should desist from destroying or removing campaign materials of their opponents as such conduct has potential to breed anarchy.

Four Lusaka Youths Nabbed for Assault

Police in Lusaka have arrested four juveniles aged between 17 and 19 years for allegedly assaulting Anthony Ndhlovu aged 18 of John Laing.

This occurred on 20th January, 2019 at about 2100 hours in Lusaka’s John Laing compound. A shovel is alleged to have been used in the act.

According to the report received, the assailants assaulted the victim after he failed to produce the money which the suspects demanded from him.

A medical report was issued to the victim and the suspects are in Police custody charged with unlawful wounding.

PF Loses Bid to Declare Roan Seat Vacant

Patriotic Front (PF) General Secretary Davies Mwila has lost his bid to have the Lusaka High Court compel Speaker of the National Assembly Patrick Matibini declare the Roan seat vacant.

Mwila had asked the Lusaka High Court to declare the Roan parliamentary seat vacant after the expelled MP Chishimba Kambwili lost an application in which he was challenging his expulsion.

Justice Mwila Chitabo has dismissed the application on grounds that the High Court has no jurisdiction over the matter and has since directed that the matter be taken to the Constitutional Court.

The Patriotic Front General Secretary in his application to commence judicial review proceedings argued that Dr Matibini’s refusal to declare the seat vacant was illegal and against article 72 of the Constitution.

He argued that the Speaker’s decision to give latitude to the court to conclusively deal with Kambwili’s case was illegal.

Mwila said that the dismissal of Kambwili’s case by the court meant that there was no challenge currently pending in the High Court to challenge the Roan parliamentarian’s expulsion from the ruling PF.

In the previous proceedings Kambwili filed an application to join the case as an interested party.

 

Kambwili has appealed the decision by the High Court to uphold  his expulsion from the PF.

Rufunsa Gets K33 Million for Road Maintenance

The National Road Fund Agency through the Ministry of Local Government has released K 33.9 Million for periodic maintenance and rehabilitation of Munyeta road, 23kilometres from the Great East (T4) Road, in Rufunsa District.

And the contract has been awarded to ABC Global Works Limited who are expected to complete the works within 12 months.

Besides the road formation, works include graveling and drainage structures. Drainage works will include construction of three box culverts at Mwapula, Munyeta and Musamba-Ngoma crossing points.

Rufunsa Town Council Chairperson Bartholomew Kalambalala is excited at the prospects of repairing the road that has been a nightmare for the people of Munyeta in Kabuyu Ward.

Kalambalala has since commanded government for considering Rufunsa Town Councils’ application to fund the project.

Chanda who is also Luanshya Mayor has also singled out people using PF colours to solicit for favours.

STOP MASQUERADING AS PF TO DO ILLEGAL ACTIVITIES WARNS NATHAN CHANDA

Copperbelt, Ndola January 24, 2019

We would like to sternly warn people that want to masquerade as PF officials or members to stop soliciting for fovours in the name of PF party on the Copperbelt Province.

We want to categorically state that PF is a party of discipline and in everything procedure is followed. We will not protect anyone who wants to use the name of the party for illegal activities.

The PF on the Copperbelt is on high alert and the law will take its course on anyone that will be found wanting. Those that want to use the name of the party, within or coming from outside the Copperbelt province soliciting for things from companies, getting illegal land and illegal business, intimidating innocent people and breaking the law with impunity and any other activities that are criminal in nature that they will not be to tolerated.

The PF under the leadership of President Edgar Chagwa Lungu will never allow any acts of criminality. PF leadership on the Copperbelt will follow the law in everything that it does. We, therefore ask our members and those that sympathize with us to do clean business.

The law is clear and we will follow the law. Let me also advise our members to use the right channels in addressing their concerns.

If any member of our party is found waiting, immediate disciplinary action shall be meted.

ConCourt Upholds Election of UPND’s Miyutu

The Constitutional Court has upheld the election of Chinga Miyutu as UPND Kalabo Central Member of Parliament.

Losing Patriotic Front candidate Richard Mwapela had filed 11 grounds of appeal that have all been dismissed.

The Mongu High Court had earlier upheld the election of Miyutu as Member of Parliament but Mwapela appealed to the Constitutional Court.

The court however found that Mwapela’s claims that Miyutu bribed voters with salt were baseless.

Justice Anne Sitali ruled that the allegations of electoral violence did affect the voters’ turn out, pursuant to section 97 (2) of the Electoral Act.

She however noted that the evidence adduced was not enough to overturn the outcome of the election.

 

“All in all, the appellant has not proved all the allegations and all the grounds of appeal are dismissed, the appeal fails in its entirety,” she said.

26-Year Chisamba Man Rapes 82-Year old Grandmother

A 26-year old man of Chisamba has been arrested for raping his 82-year old grandmother.

Provincial Police Commissioner Chola Katanga has confirmed the incident identifying the suspect as Supren Musekiwa, who is currently in police custody.

Katanga said the mother to the victim reported the matter to the police after the victim narrated to her what happened.

The matter was reported to the police by daughter to the victim Lillian Mungo.

The police commissioner said the officers mobilised and arrested the suspect who had attempted to escape.

Katanga explained that the victim was also forced to drink some unknown substance by the grandson after the rape.

Meanwhile, Katanga has disclosed that Police in Mkushi have launched a manhunt for a man of unknown age for allegedly defiling an 11 year old girl who was left under his care.

He said the suspect who has been identified as Peter Daka of Mkushi repeatedly defiled the 11 year old girl.

Katanga stated that the victim’s parents had travelled to Lusaka for a visit but had to cut short their trip after they were alerted of the defilement case.

Tembo Pleads to Withdraw Eswatini Land Case

Patriots for Economic Progress (PeP) Party Leader Sean Tembo has pleaded with the Constitutional Court to allow him withdraw the matter in which he had wanted the court to declare that President Edgar Lungu violated the constitution by accepting the Eswatini land as a gift without declaring it to the state.

Tembo has reneged on his desire to pursue the matter and has since applied to have the matter withdrawn.

However, the Attorney General has refused to have the matter withdrawn opting to see out the legal process.

Attorney General Likando Kalaluka has argued that the matter is a legal one while Tembo has advanced political reasons for his application.

Tembo claims that he has decided to withdraw the matter in the spirit of the conciliatory national dialogue process.

In his affidavit filed before the court Tembo submitted that if the matter is not withdrawn as per his request, it would mean that political parties leaders including himself would have to go to the 2021 polls with a carry forward of the political tension that existed in the 2016 general elections.

Tembo had a change of heart after his attempt to subpoena State House press aide Amos Chanda and Information Minister Dora Siliya failed.

The state has however argued that abandoning the case on account of national dialogue would not guarantee that the petitioner would not change his mind when the dialogue fails.

State Advocate Joe Simachela submitted that the petitioner’s action was politically motivated and therefore an abuse of the process of the court.

Simachela has also asked the court to take judicial notice of its ruling dated November 28 last year in which it dismissed the petitioner’s application to subpoena witnesses to testify on its behalf.

Both applications are yet to be heard and determined by the full bench.

Mtendere Police Post Land in Legal Jeopardy

A Mtendere Township resident Hurst Matende has asked the Lusaka High Court to stop the construction of Mtendere Police Post on grounds that part of the land it sits on belongs to him.

Matende has sued Patriotic Front Mtendere Ward 33 Councillor Watson Mtonga for allegedly demolishing a property to pave way for the extension of the Mtendere police post.

According to a statement of claim filed by Matende who has also sued Wamuba Construction Company, the plaintiff says he purchased the said property located on plot Number 4052 / Block C Mtendere Township from Jane Namugala at a cost of K 35,000 in which both parties executed a deed of assignment where a copy of the certificate of title deed was surrendered.

He said in June, 2018 he received a phone call from Mtonga directing him to stop transacting with Namugala as the said property was earmarked for the extension of the police post.

Matende said upon receiving the information he went to verify the facts with the Lusaka City Council where he was informed that what the councillor had told him was not true.

He said that despite having notified the councillor of the legal status of the police post, they went ahead and demolished his property as part of the plans to extend the police post.

Matende is claiming K500, 000 as compensation for the demolition of the house, an injunction retraining the defendants either by their agents or servants from trespassing , interfering or carrying out any developmental activities on the said property.

He is further claiming for damages for the inconveniences caused by the defendant’s action of threatening and demolishing of the property.

Buthelezi to Grace 2019 N’cwala Ceremony

Prince Mongosuthu Buthelezi of the Zulu Kingdom of Kwazulu-Natal(KZN) South Africa will grace this year’s N’cwala Ceremony of the  Ngoni people of Eastern province.

This follows an invitation by the Nc’wala Organising Committee.

Prince Buthelezi who is from the Zulu Royal Establishment expressed gratitude to the Royal Highness paramount Chief Mpenzeni   for inviting him to be the guest of Honour at this year’s N’cwala ceremony to be held on the 23rd of February.

In a letter addressed to the Zambia High Commission in  Pretoria South Africa Prince Buthelezi confirmed his participation in the ceremony.

The prince says he will also pay a courtesy call on his Excellency President Edgar Chagwa Lungu and Foreign Affairs Minister Hon Joseph Malanji before proceeding to Chipata for the ceremony

The Prince becomes the First official from the Zulu Royal Family to grace the ceremony in recent years.

And Zambia’s High Commissioner to South Africa Mr. Emmanuel Mwamba has hailed the deepening Cultural Ties between Zambia and South Africa.

Mr. Mwamba says the Ngoni Speaking people of Zambia and the Zulus of South Africa have a lot in common due to the fact that they share the same ancestral origins.

He noted that there is need to enhance and preserve the cultural ties the two countries have enjoyed over the years.

UPND Sheds Light on Political Alliance

The opposition UPND has spoken out on its alliance with 10 other political parties.

UPND secretary General Stephen Katuka has gone some way in answering some lingering questions on the alliance that has been questioned on the basis on commonality.

The UPND has previously entered into political marriages that have fallen through like the United Democratic Alliance (UDA) in 2006 and the infamous pact with the PF prior to the 2011 which also crumbled.

 

Katuka has also revealed that the party has banned lowly ranked officials from talking about the alliance without clearance from the General Secretary.

The United Party for National Development, UPND believes in collective responsibility in addressing national issues hence its decision to enter into a respectable and practical Alliance with 11 other likeminded and progressive political parties with a common goal of tackling the deficits with a focused and holistic approach as it is our belief that no man is a fountain of wisdom.

Our allegiance to the Alliance of political parties is premised on the belief that Zambia as a country is bleeding from the numerous atrocities and misplaced priorities under the PF leading to a total collapse of its economic and social gains of early 2000 when visionary leaders ruled this country.

We have time and again called for a collective political front for the sake of national peace and growth as we believe that every person has the requisite skill and intellect in contributing to national development which must be harnessed fully.

Being the democratic party that it is and a believer in the tenets of freedom of speech, the UPND allows its members to freely express their views and opinions. However all UPND officials are advised to engage the office of the Secretary General before commenting on policy matters bordering on the Alliance of political parties.

Nkana, Zesco Face Off in Charity Shield

The Zambian football calendar rolls into life this afternoon with the season opening Samuel’ Zoom’ Ndhlovu Charity that pits Zesco United and Nkana.

Both teams have made the CAF Confederation Cup group stage and are pitted in the same group that will see them face each other over two legs.

Today’s contest is a dress rehearsal of the CAF Confederation Cup in a week’s time.

Nkana overcame Zesco United 4-3 in the same competition in 2018 at Nkoloma Stadium and it could be payback time for the Ndola side this afternoon at Arthur Davies Stadium.

Zesco has firmly established itself as a continental force in the last few years and graded in top 10 African club sides.

All eyes will be on the prolific Lazarous Kambole who is arguably the hottest player in local football at the moment alongside the imposing Jeses Were who has also become a huge fan favourite.

However Nkana have equally the reputation to match any side with the talismanic Ronald ‘Sate Sate’ Kampamba alaongside skipper Walter Bwalya.

Nkana also have more fluidity in 2012 Africa Cup winning midfielder Chisamba Lungu and the skilfull Harrison Chisala who could be game changers.

The Charity Shield precedes the opening of the Super League with teams getting into action on Sunday.

Kickoff for the Charity Shield is at 15:00 hours and the game will be live on SuperSport.

Lightning Strikes 2 Females to Death in Chiengi

Two people have died after being struck by lightning in Chiengi District of Luapula Province.

The two who died on the spot have been identified as Jane Mumba, 23, and Janet Muyamba, 17, both of Musinsa Village, Chief Puta.

Police Spokesperson Esther Katongo who confirmed the development said the incident happened on Thursday and the two have since been buried.

“This occurred on 24th January, 2019 around 13:00 hours at the named village. The two were outside their house when they were struck. Their bodies have been buried,” Katongo said.

Meanwhile, a 57 year old woman has died after the grass thatched house collapsed on her following a heavy downpour in Mwansabombwe District.

The deceased has been identified as Mumba Binaisa of Jolopu Village in Chief Kazembe’s area.

“Police in Mwansabombwe District received a report of sudden death in which female Mumba Binaisa aged 57 of Jolopu village Chief Kazembe in Mwansabombwe District died after her grass-thatched house in which she was collapsed due to heavy rainfall,” she stated.

PF Ndola Councillor Suspended over Mealie Meal Smuggling

Police in Ndola have arrested Patriotic Front Kamba Ward Councillor Oscar Himanga after he allegedly attempted to smuggle 70×25 Kilogramme bags of mealie meal to the DRC through an illegal bush path in Kawama area via the Ndola-Mufulira road.

Copperbelt Commissioner of Police Charity Katanga has confirmed the development stating that Himanga was picked up by police on Monday and is set to appear in court soon.

Himanga who is also District Youth Chairman for the ruling party was released on Friday after being detained from Monday.

And the Patriotic Front in Ndola District have with immediate suspended Himanga for gross misconduct.

The move comes barely a day after Provincial Chairman Nathan Chanda warned that the party will punish all individuals breaking the law with impunity.

Kabangwe Resident Pushes on Nullification of 44 UPND Seats

The 44 opposition UPND Members of Parliament that were suspended from parliament for shunning President Edgar Lungu’s address have asked the court to allow them subpoena witnesses in the matter where a Kabangwe resident wants their seats declared vacant.

When the matter came up before Constitutional Court Judge Enock Mulembe the defendants requested the court to give them guidance on when they should make an application to subpoena the witnesses.

In its ruling the court said that the defendants will be allowed to subpoena witnesses when all parties file the record of proceedings and the skeleton arguments.

Justice Mulembe, has since advised the Petitioner Richard Mumba to file his skeleton arguments by March 5, 2019 and allow for a status conference on March 7 in which the defendants may respond on March 19.

After the skeleton arguments have been filed, the court will then hear the case on March 26.

In the last session the petitioner asked the  Court to grant him an order for leave to amend the process which has since been granted.

According to an affidavit in support of summons for leave to amend process pursuant to Order IX Rule 19 of the Constitutional Court Rules, Mumba is desirous to amend the process by adding Articles 9 (2) which were left out in the originating process.

In this case Mumba petitioned the Constitutional Court seeking a declaration that the seats of 53 UPND MPs among them  Mazabuka MP Garry Nkombo and 52 others be declared  vacant for boycotting the state of the nation address to the National Assembly by President Lungu.

PF Expels Kalaba

The ruling Patriotic Front has expelled its Bahati Member of Parliament Harry Kalaba from the party with immediate effect.

Kalaba has been expelled, 12 months after having resigned as Foreign Affairs Minister.

Patriotic Front Secretary General Davies Mwila told a media briefing that Kalaba has been expelled for gross misconduct.

The disciplinary action was instigated by the Luapula Province PF committee that wrote to the Central Committee.

Kalaba has since his resignation from government being at the helm of the Democratic Party that intends to float him as their Presidential candidate in the 2021 general elections.

STATEMENT BY PF SECRETARY GENERAL, HON DAVIES MWILA,

Good Afternoon,

 

The Central Committee of the Patriotic Front met today for a special sitting to receive and deliberate on the Report of the Party’s Disciplinary Committee regarding in the case of Honourable Harry Kalaba, PF Member of Parliament for Bahati Constituency.

 

BACKGROUND

The Central Committee received a recommendation from The Luapula Provincial Committee during the Central Committee meeting held on 24th March 2018 to expel the Bahati Member of Parliament, Honourable Harry Kalaba from the Party citing various reasons.

The Central Committee referred the matter to the Disciplinary Committee of the Central Committee for further action. In the process of reviewing the grounds advanced by the Provincial Committee against Honourable Kalaba, the Disciplinary Committee took judicial notice of newspaper statements attributed to Honourable Harry Kalaba, which statements bordered on utter disregard and disrespect for The Party, its leadership and Party Constitution.

On 15th October 2018, as Secretary General of the party I wrote a letter to Honourable Kalaba, asking him to exculpate himself on four charges leveled against him arising from newspaper statements attributed to him.

Honourable Kalaba, responded to my letter through on 16th October 2018. In the said letter, Honourable Harry Kalaba failed to exculpate himself as he failed to address to the allegations that were levelled against him.

On 14th of January 2019, as Secretary General of the Party, I wrote a letter to Honourable Kalaba inviting him for a disciplinary hearing at the Party Secretariat on the 22nd of January 2019.

Mr. Kalaba did not present himself for the hearing before the Disciplinary Committee.

On 22nd of January 2019, the Disciplinary Committee held a meeting to deliberate on the case of Mr. Kalaba.

The Disciplinary Committee found Mr. Kalaba guilty on several counts:

1)      Acting in a manner that is likely to bring the name of the Party into ridicule or contempt or disrepute. This is as per Regulation (29c) of the Patriotic Front Constitution.

 

2)      Spreading false information or rumours which tend to injure the reputation of the Party, or any of its leaderships contrary to Regulation 29(h) of the Patriotic Front Constitution.

3)      Committing any act which in the opinion of the Central Committee is not in the interest of the Party contrary to Regulation 29(o) of the Patriotic Front Constitution.

AVAILABLE SANCTIONS

Article 19 of the Party Constitution and the disciplinary Code Handbook at Page 13 provides for sanctions. Depending on the seriousness of misconduct or the offence by the member the following sanctions shall apply:

(A)    simple warning or caution

(b)     written reprimand censure

( c)     demotion in office

( d)    suspension from office or function in the party for a specified period

( e)     expulsion from the party by the central committee

Looking at the factors above, Central Committee heard that Mr. Harry Kalaba had grossly misconducted himself and has continued to do so with impunity.

Central Committee also heard that the Respondent had no respect nor regard for the Party leadership as he even decided to stay away from the disciplinary hearing without giving reasons.

Central Committee further noted that the respondent had been accorded Procedural Fairness in this case by providing an opportunity for him to be heard. From the available sanctions under the Party’s Disciplinary code, the Central Committee adopted the recommendation by its disciplinary Committee that sanction (e) would be commensurate to the offences committed by the Respondent.

RESOLUTION

I wish to announce to the people of Bahati Constituency and the nation at large that Central Committee unanimously agreed to expel Mr. Harry Kalaba from the Party and by virtue of this decision; the Honourable Speaker will be notified to declare Bahati Parliamentary Seat Vacant.

Nkana Outclass Zesco to Lift Charity Shield

Nkana have won the Charity Shield for the second successive season after defeating Zesco United 5-4 on post-match penalties.

The final was a repeat of the 2018 edition when Nkana defeated Zesco United 4-3.

Zesco had started strongly with Maybin Kalengo opening the score in the second minute with a long range strike that gave Kelvin Malunga little chance in the Nkana goal.

However, Nkana bounced back in the 46th minute through their golden boy Ronald ‘Sate Sate’ Kampamba who poked from close range to level matters.

The game ended 1-1 in regulation time before it went to penalties where Mischeck Chaila was the villain after he missed his effort with Nkana’s Ben Ben Bahn cooly slotting his spot kick in the left corner to seal off the victory for the 12 time Zambian league champions.
