Hichilema Mourns Lupando

Opposition UPND president Hakainde Hichilema has joined other citizens in mourning former Republican Vice President Lupando Mwape.

Mwape who campaigned for the opposition UPND in the August 2016 elections died on Monday morning in South Africa where he had been evacuated to.

We mourn Hon. Lupando Mwape

We have received the death of former Vice President, Lupando Mwape, with shock and grief. Hon Mwape was part of the campaign team of UPND that canvassed the whole of Zambia in 2016. The wisdom and guidance that he provided during the campaign was invaluable. We all recall that Hon Mwape was a poet who would campaign in song and lamentations. An attribute we shall greatly miss together with his perceptive insights.

To the family of the departed, please take heart. The Lord God has a plan and the fact that it’s He who decides when to give and take, should be comforting. God cannot give you something you cannot handle. Remain prayerful as we too pray for you in this tragic moment.

To all UPND supporters and sympathisers. Let us support the family of the late Hon Mwape. Please offer anything you can to the bereaved to lighten their burden.

May the soul of our brother rest in peace, We will greatly miss this Zambian fountain of wisdom.

How a Failed Election Could Lead to a Violent Uprising

On December 30, 2018, millions of citizens of the Democratic Republic of the Congo braved torrential downpours, navigated chaotic crowds, and stood in long lines to do something they had not done in seven years: vote. According to Congo’s constitution, elections were supposed to have been held in 2016, but the regime repeatedly delayed them. After a failed effort to lift presidential term limits, Congo’s leadership finally relented to mounting domestic, regional, and international pressure, agreeing last year to hold elections and endorsing a successor from the ruling coalition.

 

Some Congolese voters held out hope for peaceful change in a country that has been ruled for 21 years by the Kabila regime—first under Laurent-Désiré Kabila and now under his son Joseph. But many suspected that the electoral commission would rig the vote on behalf of the ruling coalition’s candidate. It came as a surprise, then, when, on January 10, the commission made the provisional announcement that someone else had won: Felix Tshisekedi, the son of a long-time opposition hero.

 

The outcome was quickly called into question. Leaked data from the electoral commission and from the Catholic Church, which fielded 40,000 electoral observers, indicates that the true winner was a different opposition candidate, Martin Fayulu, and rumors are swirling of a backroom deal in which Kabila agreed to name Tshisekedi president, presumably in exchange for continued control over the security services and the maintenance of the Kabila family’s wealth. The regime seems to have calculated that anointing the ruling party candidate as president would have been a bridge too far in a country where the governing class is deeply unpopular, and so it settled on Tshisekedi, apparently a more accommodating opponent than Fayulu, as a fallback option.

In the short run, the announcement of an opposition victory likely averted an immediate popular uprising. But by demonstrating to Congolese that true reform is unlikely to happen through the ballot box, it has sown the seeds for deepening disorder and instability down the line.

Ex-North West Minister Convicted of Corruption

Former North Western Province Minister Fabian Mumba has been convicted by the Solwezi Magistrate Court for corrupt practices.

Mumba was in 2007 arrested by the Anti-Corruption Commission and was jointly charged with the then Procurement Manager at the Provincial Administration Collins Kapapala for one count of wilful failure to comply with applicable procedures and guidelines contrary to the Laws of Zambia.

This was in the case of abrogating guidelines relating to the procurement of works for the upgrading and maintenance of the Margrade Extension Road in Solwezi which was awarded to Hillers Construction Company Limited contrary to section 33(2) of the Anti-Corruption Commission Act number 38 of 2010.

Particulars of the offense were that Mumba and Mr Kapapala, on dates unknown but between January 1, 2011 and August 31, 2011 did wilfully fail to comply with applicable laws, procedures or guidelines.

When the matter came up before Principle Resident Magistrate Davies Chibwili in the Solwezi Magistrate Court, Collins Kapapala walked to freedom after being acquitted while his boss has been handed a six monthsjail term but suspended for two years.

DEC Nabs 2 Nakonde Business Persons for K2 Million Theft

Lusaka, Tuesday, 22nd January, 2019-The Drug Enforcement Commission in Lusaka has arrested two people for theft and money laundering involving over K 2 million, contrary to the laws of Zambia.

The two are identified as George Siame, 45, a businessman of Katozi Village in Nakonde and Ruth Ngoma, 42, also a business woman of the same village.

Particulars of the offence are that on dates unknown but between 11th January and 8th November, 2018, jointly and whilst acting together with other persons unknown, the duo, being directors of Goshen Farms and Agro dealers, stole bags of fertiliser worth K 2, 221, 884 from a known fertiliser company. The duo further distributed the said fertiliser to various farmers using the e-voucher Farmer Input Support Programme and laundered funds realised from the scheme by transferring funds to other accounts as well as making cash withdrawals to purchase various properties.

Both suspects are on police bond and will appear in court soon.

The Commission wishes to caution small-scale farmers to be weary of unscrupulous individuals or businesses and always report any suspicious transactions in order to avoid falling prey to such illegalities.

2018 G12 Pass Rate Records Marginal Drop

The number of grade 12 candidates that have obtained school certificates in the 2018 examinations has reduced by 1.40 percent.

Announcing the results in Lusaka this morning, General Education Minister David Mabumba said a 63.44 percent pass rate was recorded compared to 64.84 percent recorded in 2017.

Mabumba attributed the decrease in performance to various factors such as the suspension of the conduct of the 2918 examinations.

He explained that according to the analysis on the performance of candidates, the proportion of boys who obtained school certificates was higher at 65.14 than that of girls which was at 61.53 percent.

The minister further said the number of schools that recorded 100 percent pass rate decreased from 73 in 2017 to 70 in 2018.

Swiss Minister Criticised for Copper Mine Comments

Swiss Foreign Affairs Minister Ignazio Cassis is coming under renewed pressure over his visit to a Glencore-run copper mine in Zambia earlier this month. Local NGOs have criticised comments by Cassis that gave the mine a glowing reference.

Last weekend Cassis said in a radio interview that he had spoken to local NGOs about environmental standards at the plant and that they had told him things had improved over the past 15 years.

But Swiss public radio, SRF,external link found that these NGOs were located in the Zambian capital, Lusaka, and not in the vicinity of the Mopani Copper mine, which is majority owned by the Swiss-based commodities giant Glencore.

SRF spoke to a person living nearby who complained of pollutants being released by the mine that affected her health. Local NGOs also complained that they were not given the opportunity to talk to Cassis about sulphur emissions.

Critics have also pointed to information on the Swiss foreign affairs ministry websiteexternal link relating to the Mopani mine, which they say gives a false impression about safety and environmental standards at the mine.

Human rights guidelines

In November, the Swiss government published human rights guidelines for firms operating in the commodity sector. Separately, it issued a report looking at the ongoing challenges and emerging trends in this sector of strategic importance for Switzerland.

Glencore, the world’s biggest mining company with headquarters in the Swiss canton of Zug, comes under regular criticism from Swiss watchdog groups over environmental and human rights issues linked to copper and cobalt mines in the Democratic Republic of Congo.

Kambwili Sued over Ngucha Energy Allegations

Ngucha Energy Corporation is demanding $180 million from Roan Member of Parliament Chishimba Kambwili over remarks that the company belongs to President Edgar Lungu.

The energy firm that operates a number of filling stations across the country has filed a legal suit in the Lusaka High Court demanding compensation for loss of business and income as a result of Kambwili’s utterances.

According to a statement of claim filed by the Corporation’s General Manager Elias Kamundi of a Kenyan nationality, Kambwili on December 4, 2018 featured on Radio Phoenix ” Let the People Talk” program where he allegedly published and issued a false statement to the effect that the company in question belongs to President Lungu.

Kamundi said that Kambwili even went to the extent of breaking down the acronym NGUCHA as is made up of the name Lungu and Chagwa.

Kambwili said NGU is from the name LUNGU while CHA is from the name CHAGWA.

Kamundi said that contrary to the allegations Ngucha Corporation is owned by two private persons who are not in any way related to the Head of State.

He said that the said company had been in existence since 2010 before Lungu became the Patriotic Front President.

Kamundi said that the company had suffered loss of business since Kambwili made the statement.

Zambia Unveils Provisional Olympic Squad

Under-23 national team coach Beston Chambeshi has summoned 30 players for a local camp ahead of the March 20 first leg Olympic qualifier against Malawi in Blantyre.

Chambeshi has roped in the bulk of his 2017 Under-20 Africa Cup winning side on home soil.

The team will enter residential camp on January 28-31 before entering the second camp on the weekend of February 11.

Chambeshi will in the final stretch include foreign based players to complete his puzzle.

Zambia will tackle Malawi in its first assignment for the 2019 Africa Cup of Nations to be hosted by Egypt.

Zambia will be away to Malawi on March 20 in the first leg before hosting the junior flames four days later.

Malawi booked a date with Zambia after a 1-1 home draw against Botswana in Blantyre on Tuesday to qualify 3-2 on aggregate following a 2-1 away win in Gaborone on November 17.

Zambia was on bye for the first round but will join the fray in the penultimate stage before the closing round.

Winner of the Zambia and Malawi game will move into the final qualifying round next June to face either Congo Brazzaville or Burundi to decide who qualifies to the Egypt finals.

The 2019 AFCON will be used as a qualifier for the Japan 2020 Olympic Games.

Top three finishers at the Egypt finals will qualify to the 2020 Tokyo Olympics.

Zambia last participated at the Olympic Games in 1988 where they famously reached the quarterfinals.

Mansa Council Destroys 264 Hazardous Loaves of Bread

The Mansa Municipal Council has seized and destroyed 264 loaves of bread worth K 2,112.00 from Dantys Down UB outlet for allegedly posing a health hazard.

Council Assistant Public Relations Manager Gladys Saili has said that the seized loaves of bread were unwrapped and displayed thereby pausing a health threat.

She said that bakery floured the provisions of Statutory Instrument No. 12 of 2018.

“The routine operations are conducted in order to ensure that the business community in Mansa District comply with the provisions of the Public Health Act Cap 295 and the Food and Drugs Act Cap 303 of the Laws of Zambia as read together with Statutory Instrument No. 12 of 2018 regulations 11, 13, 16, 17, and 22,” she said.

Saili has since advised other bakeries in the district adhere to health regulations failure to which they risk having their products destroyed by the health department at the Municipal Council.

More Mine Firms Back Down on Job Cuts

Luanshya Copper Mines has joined the growing list of mine firms that have backed down on firing employees in the wake of the new tax regime.

And First Quantum Minerals has also announced that it will not be laying off workers in response to the new tax regime.

Mineworkers Union of Zambia President Joseph Chewe says LCM has opted to engage government over the controversial tax regime.

Chewe said the move taken by Luanshya Copper Mines need to be emulated by other mining firms that earlier announced plans to cut jobs in the industry amid changes on the tax regime.

Chewe stated that the move taken by Luanshya Copper Mines as well as Mopani Copper Mines is a move in the right direction and will help in safeguarding jobs.

He said job cuts in the mines are detrimental as they end up depriving government from collecting the much needed revenue and could send youths on the streets.

Chewe and his team has been engaging mine owners on the sidelines to take a dialogue approach as opposed to laying off workers in view of new mine tax regime.

Sinkamba Demands $323,560 from Mines Audit Conducted

Kitwe High Court Judge Mercy Makubalo has set 14 March, 2019 as the date for hearing of the application by Green Party President Peter Sinkamba for an order for leave to commence contempt proceedings against Mines Permanent Secretary Paul Chanda, Director of Mines Safety Department Gideon Ndalama, and Acting Director of Mines Safety Department Fred Banda.

The application is in respect of the judgment of the court delivered on November 27, 2017 where Judge Makubalo ordered that Sinkamba be paid the sum of US$323,560.00 for the environmental audits which he conducted in 2009 on behalf the Mines Safety Department for the Environmental Protection Fund (EPF) under the Ministry of Mines and Minerals Development.

“I am, however, of the firm view that the petitioner (Mr. Sinkamba) is still owed US$323,560.00 and I direct that it must be paid with interest at the current bank lending rate from 16th February, 2009 up-to-date and hereinafter at six per cent until the whole debt is discharged,” Judge Makubalo directed in the judgment dated 27th November, 2017.

However, despite several reminders, the trio has not paid the interest and costs more than one year after the judgment was delivered.

In his affidavit in support of the summons for leave to file contempt proceedings, Sinkamba states that the judgment was served on Paul Chanda and Gideon Ndalama and that the duo was advised by the Attorney General to liquidate the judgment debt plus interest and costs from the Environmental Protection Fund as the purpose of the Fund is to inter alia insulate the Government incurring costs related the EPF.

He states that in April 2018 the Ministry of Mines paid the principle amount from EPF and that unfortunately, said Permanent Secretary Paul Chanda, Director of the Mines Safety Department, and the Acting Director of the Mines Safety Department have defied to pay the interest and costs.

Sinkamba goes to state further in his affidavit that the trio has also defied directives from the Republican President, the Minister of Mines, the Secretary to the Treasury and the Attorney General to close the matter by paying the interest and costs as ordered by the court but trio has obstructed or indeed prevented the enforcement of the court directive on baseless grounds.

“That prior to the payment of the principle amount the said Permanent Secretary had deliberately misinformed the Attorney General that the EPF has no capacity to pay the accrued interest when in fact not as the EPF had over twenty million dollars (US$20,000,000.00) in its coffers,” Sinkamba stated in the affidavit.

He adds“…it is unfortunate that civil servants, who should be in the forefront in respecting court judgments, and the constitution of Zambia, can wilfully choose to defy not only the court but also the President, Minister and Constitutional Office holder”.

“In the interest of preservation of respect of court decisions, and in the interest of justice to me, the said Paul Chanda, Gideon Ndalama and Fred Banda, be committed to prison for contempt of court so that they appreciate the gravity of the offence of contempt of court, and to serve as a lesson to other civil servants who are in the habit of defying court decisions,” Sinkamba states.

Chipata to get High Court

THE Judiciary has secured land for the construction of a High Court in Eastern Province.

The High Court will be situated near Katopola farm institute in Chipata district.

Eastern Province minister Makebi Zulu yesterday led a team of a visiting delegation from the judiciary infrastructure committee to Katopola farm institute where government has allocated a 200 by 200 metres piece of land.

Committee chairperson Justice Charles Kajimanga said other than Chipata, the judiciary would build High Court buildings in each of the provincial headquarters where it normally circuits.

Justice Kajimanga said every time when the High Court circuits in areas such as Chipata, Mongu, Solwezi, Mansa and Kasama it takes over the chambers of the magistrates and the court rooms thereby affecting the operations of the lower court.

He said the committee had been going round the provinces to look for land where they could build a High Court and land where they could build an institutional house for the resident judge.

Justice Kajimanga said his committee had been receiving good responses from provincial administrations wherever they had gone.

And Zulu said the provincial administration had already secured land for the High Court.

He said Chipata had few law firms because of the non-availability of the High Court.

Lsk Trio Jailed for Operating Banking Business without a Licence

The Lusaka Magistrates Court has convicted three directors of Heritage coin Resources Limited and sentenced them to two years simple imprisonment for conducting banking business without a licence as the trio collected deposits from the public disguised as partnership fees involving K 28, 346, 800.

The three convicts are identified as Hilda Agnes Raubenheimer, 35, Orient Rio Zekko, 29 and Tapiwa Chirwa, 40, all of Lusaka.

The three were arrested by the Commission on 9th November, 2018 and were convicted this morning when they appeared before Lusaka Magistrate Honourable Humphrey Chitalu who sentenced them to two years simple imprisonment each with effect from 9th November, 2018.

Further, the company Heritage Coin Resources Limited has been convicted and fined K150, 000 and in default a warrant of distress will be issued against its property.

The Commission has since welcomed the judgement which will serve as a lesson to perpetrators of money laundering crimes and spur the Commission’s efforts in a quest to rid the country of money laundering as well as emerging cyber fraud.

Lupando Gets 3-Days National Mourning

The body of former Vice President Lupando Mwape will be repatriated to Zambia on Friday January 25, 2019.

Mwape died on Monday morning in South Africa where he had been evacuated for specialist treatment.

HON. LUPANDO MWAPE’S BODY TO BE REPATRIATED TO ZAMBIA ON FRIDAY, 25TH JANUARY 2019

Pretoria-wednesday 23rd January 2019

The remains of former Vice President of the Republic of Zambia, Hon. Lupando Mwape will be repatriated to Zambia on Friday 25th January 2019.

Zambia’s High Commissioner to South Africa, His Excellency Emmanuel Mwamba, stated that processes and logistics regarding the repatriation of the remains were complete.

He said the body will arrive on Friday in Zambia aboard South African Airways at 15hrs.

The body will be accompanied by the widow, Mrs Happy Prisca Mwenya Mwape and Mr. Mwamba.

President Edgar Lungu has declared a 3-day period of national mourning that is expected to begin once the body arrives in Zambia.

Hon. Mwape served as Vice-President of Zambia from 2004 to 2006 under President Levy Mwanawasa.

He also served as Zambia’s Ambassador to the People’s Republic of China.

Meanwhile, Mr. Mwamba has also disclosed that Zambians living in South Africa will hold a memorial service for Hon. Lupando Mwape on Thursday,24th January 2019 at 17hrs.

He said the service will be held at St Martin de Porres Catholic Church Est in Craighall Park.

He said the Church is situated at 35 Lancaster Avenue, Craighall Park, 2196, Johannesburg.

Hon. Lupando Mwape died on Monday at Avrywp Medical Centre in Johannesburg.

CAF Lifts Sikazwe Suspension

CAF has lifted the provisional suspension of top FIFA referee Janny Sikazwe after being accused of corruption in November last year.

The top referee who has been flying the Zambian and African flags high has been handed a reprieve by the CAF Disciplinary Committee.

“After having thoroughly checked the elements presented to them regarding the violation by Mr Janny Sikazwe of CAF Regulations, in particular Arts. 82, 136, 152, of the CAF Disciplinary Code: The Disciplinary Board decided that there is no sufficient evidence to implicate the involvement of Mr. Janny Sikazwe regarding the allegations of corruption made against him. Therefore the Disciplinary Board decides: The provisional suspension of Mr. Janny Sikazwe is lifted,” states correspondence from CAF.

 

Sikazwe was suspended following corruption allegations – in violation of CAF Regulations Articles 82, 136 and 152 of the CAF disciplinary code – raised by Angolan outfit Primeiro de Agosto in their 2018 CAF Champions League semi-final, second leg match with eventual champions Esperance de Tunis.

Sikazwe officiated at the FIFA World Cup in Russia in 2018 making history as he became the first Zambian to achieve that feat,

Initiative to deploy Zambian teachers to Madagascar applauded

The initiative by the Zambian government to send 500 teachers to Madagascar has been applauded.

Matthews Muyembe, an economist based in Kitwe, Zambia told the media that the agreement between the two countries will help increase the Zambian foreign exchange earnings base.

“Deploying teachers to Madagascar will help earn forex as those teachers will be investing back home,” he said.

He also noted that the development will help cushion the weakening Kwacha against major exchange currencies.

“Economies do not only trade in commodities but also invest in human capital through initiatives such as deploying teachers and other professionals to other countries as a way of earning revenue,

“Government spends a lot of money on training teachers unlike other disciplines hence it was imperative that the state undertake such commercial activities and bilateral agreements that will plough back what was spend on the education sector,” Muyembe told ZANIS.

He said the move was also an opportunity for the teachers who will be deployed to gain experience and foreign exposure for them to come back with new lessons which could be implemented in Zambia when they return.

He further stated that this will promote regional integration and create employment for teachers that have not been recruited by the government.

The announcement that the teachers would be deployed to Madagascar was made after a bilateral meeting between the Madagascar President Andre Rajoelina and President Edgar Lungu last week.

Recently, the National Action for Quality Education Executive Director Aaron Chansa said both the public and private sectors cannot accommodate this important human resource, currently.

“Therefore, the Madagascar deal will create employment and allow these teachers to go and learn other teaching practices, values and work ethics in that country,” said Chansa.

Defilement Accused G.9 Pupil Awaits Age Determination for Victim

A grade 9 pupil of Lusaka’s John Laing Primary School has admitted defiling his girlfriend from his parent’s house whose real age is not known.

The suspect aged 18 has told the court that he had unlawful carnal knowledge of his juvenile girlfriend because she allowed him and told him that she was 17. He told the court that he only had sex with the victim once.

He is facing one count of defilement contrary to the Laws of Zambia and has pleaded guilty to the charge.

But Magistrate Nsunge Chanda has asked a social welfare officer to bring the victim to court to determine her real age.

She said the juvenile offender can use the victim’s age as his defence if he is convinced that she is not a minor.

The suspect remains in custody until February 29 when the matter comes up for hearing of facts.

Zimbabwean music legend Oliver Mtukudzi dies

African music legend Oliver Mtukudzi has died.

The iconic 66-year-old musician, nicknamed Tuku, had been struggling with his health for over a month.

Jazz musician Oliver Mtukudzi has passed away, according to multiple news sources in Zimbabwe.

 

A tweet was initially sent out by Zimbabwean publication Masvingo Mirror.

According to the tweet, the publication “has it on good authority that he died two hours ago in the ICE at Avenues Clinic in Harare”.

The musical icon’s death has since also been reported in NewsDay as well as Health Times, who reported that the death has been confirmed by a reliable family member.

His record label, Gallo Record Company, has also confirmed his passing.

The 66-year-old musician, nicknamed Tuku, had been struggling with his health for over a month.

No statement has been released yet by the family and the cause of Mtukudzi’s death is not yet known.

Tributes immediately began pouring in on social media.

As well as possibly the country’s best-known musical export, Mtukudzi was a businessman, philanthropist, human rights activist and UNICEF Goodwill Ambassador for Southern Africa Region.

He released 58 albums.

Immigration Shed Light on ‘Deported’ Russian National

The disappearance of a Russian national from Zambia last week continues to raise dust with the immigration department weighing in with an explanation.

Last week Vice President Inonge Wina ordered an inquiry in an incident where Russian national Sergey Kuznetsov of Gemcanton Emerald Mine was allegedly kidnaped.

Below is the statement from the Immigration Department

RE:    THE DEPARTURE FROM ZAMBIA OF MR. SERGEY KUZNETSOV OF GEMCANTON EMERALD MINE

The Department wishes to set the record straight on the story that has dominated the media space on Mr. Sergey Kuznetsov of Gemcanton Emeralds Mine. We have observed the consistent use of the term ‘Deportation’ by some media houses in reference to the departure from Zambia of the Russian.

This is very misleading and has compelled us to clarify the matter. We have no intentions, at this moment to comment on the allegations of abduction as this is a matter under investigation. We however think it is imperative to comment on the alleged deportation.

A Deportation refers to a removal out of Zambia of a foreign national under a warrant of deportation signed by the Minister of Home Affairs, pursuant to section 39(1) and (2) of the Immigration and Deportation Act. A deportation will arise in the following two circumstances:

A none Zambian has served a prison sentence in Zambia; or

It is the opinion of an immigration officer that the presence or conduct of the none-Zambian is likely to cause danger or breach of peace and good order in Zambia.

In both scenarios, the Director General makes recommendation to the Honourable Minister of Home Affairs for consideration. If the Honourable Minister is satisfied with the grounds of the recommendation, he then signs a warrant of deportation, which is then executed.

Whenever carrying out a deportation, the deportee is escorted by Immigration Officers. Lastly, a deportee shall not be admitted to Zambia unless under exemption by the Minister of Home Affairs.

It is clear that Mr. Kuznetsov was not deported from Zambia, as there was neither a signed warrant of  deportation by the Minister of Home Affairs nor Immigration Officers to carry out the deportation. On the contrary, he presented himself before immigration for exit clearance like any other person wishing to travel out of the country.

Pres. Lungu Confers with Diplomatic Community

President Edgar Lungu has touched base with the diplomatic corps in Zambia assuring of the country’s total cooperation with the donor community.

During the annual shake and greet ceremony for diplomats President Lungu disclosed that government will hold a first ever Economic Diplomacy Forum this year in Lusaka.

The Head of State said that Zambia enjoys good relations with the diplomatic community and would continue to strengthen the ties.

President Lungu assured the diplomats that Zambia would continue to guard against abuse of donor funds and also stick to stick democratic tenets.

He also expressed confidence that SADC member states scheduled to hold elections this year will do so in an equally peaceful manner to ensure political stability in the region.

 

Meanwhile Dean of Diplomatic Corps and Ambassador of Angola to Zambia Balbina Da Silva urged the diplomatic community to emulate Zambia’s commitment to peace and stability.

 

He commended Zambia for upholding peace and unity as well as promoting good governance in the southern African development community and the global community.
