The notorious Tokota boys of Kitwe have concluded their defence in the Kitwe High Court with the last two gang members testifying in the case they are accused of having brutalized Cathdeck Nkonde whom they even made eat his own faeces.
This is in a case the 18 gang members are charged with three counts of causing grievous harm, unlawful wounding and poisoning and kidnapping a juvenile contrary to the laws of Zambia.
When the matter came up for continued defence before Kitwe High Court In Charge Timothy Katanekwa, Hills Mwamba, 28, of Ndeke Township, who is the 17th suspect told the Court that he was only picked up from his home by the Community Crime Prevention Unit Officers who informed him that he had assaulted a Congolese national but was shocked that he was taken to Kitwe Central Police station for the offenses he was appearing in court for.
He accused the arresting officer of having excluded where he was picked from in the warn and caution statement recorded because he was not part of the group that grievously harmed, wounded, and kidnapped the complainant.
And Trust Sinkala, 20, of Mulenga Over Spill who is the 18th suspect also denied the charge saying he was never part of the gang that brutalized the complainant.
Sinkala told the Court that he was picked up by police while on his way to the clinic as he waited for the bus at Kamfinsa bus station.
The 18 where apprehended after a video circulated on social media where a young man was forced to eat his faecal matter a move that prompted a public outcry.
Facts before court are that, in the first count the 18 are charged with acts intended to cause grievous harm contrary to section 224 (a) of the Penal Code Chapter 87 of the laws of Zambia.
Particulars of the first court are that the 18 suspects on the 30th of April 2018 in Kitwe District, whilst jointly acting together with other persons unknown intent to maim, disfigure or disable did cause grievous harm to a male juvenile.
In the second count, they are charged with unlawful wounding or Poisoning Contrary to section 232 (b) of the penal code of chapter 87 of the Laws of Zambia.
Particulars of the offence are that the 18 suspects on the 30th of April 2018 whilst acting together with intent to injure or annoy, caused noxious things namely faeces to be taken the Juvenile.
In the last count the 18 are charged with kidnapping or abducting in order to subject person to grievous harm contrary to section 257 of the penal code of the Laws of Zambia.
