High Court Discontinues Biti’s Asylum Case

The Lusaka High Court has discontinued the case in which Zimbabwe’s opposition leader, Tendai Biti challenged the Zambian authorities’ decision to refuse him entry in the aftermath of elections in his country.

Biti had sought asylum in Zambia but was send back to his country.

Judge-in charge Pixie Yangailo has discontinued the matter for want of jurisdiction.

Last year, Biti crossed over to Zambia to seek asylum after he lost the presidential elections.

According to the sequence of events Biti was expected to appear for an ex-parte hearing before Justice Yangailo in a matter where he was challenging the decision by the government to deny him leave to apply for refugee status in Zambia.

But when the matter came up for a possible hearing,  Biti’s legal team informed the court that their client was not before court because he had been deported.

They sought an adjournment to allow them time to file necessary documents following the alleged disobedience to the court order.

According to the legal team, the Zambian Immigration office handed him to the Zimbabwean authorities despite being served with a court order to bring him to court on that day.

And the Attorney General, Likando Kalaluka objected to the application for adjournment that the court wanted to deal with the disobedient order and adjourned the matter to a date to be advised to the parties.

Government had indicated that Biti’s grounds for asylum were weak and he could not be allowed to stay.

This forced the Zimbabwean opposition leader to apply for Judicial Review citing the Attorney General as the respondent.

Infrastructure and Housing minister Ronald Chitotela says engineers from Japanese International Cooperation Agency have submitted a preliminary design of the new Luangwa Bridge.

Chitotela said the design indicate that the new Luangwa bridge will be 500 metres long compared to the current one which is 300 metres long.

“What they are suggesting is that the Luangwa Bridge will not curve.

So yes we received a team from JICA who have done the preliminary design and have submitted a report. A report was very impressive because they are saying a direct bridge will reduce the cost because of the rock view. So the distance will be about 500 metres instead of the current which is 300 metres,” Chitotela said.

Chitotela said when President Lungu went to Japan, the Prime Minister promised him to send a team to check on the bridge.

The minister said this after outgoing Eastern Province Permanent Secretary  Chanda Kasolo asked him on how far the Luangwa Bridge project had gone when the minister paid a courtesy call on Tuesday.

Chitotela was in Eastern Province to check on the progress on the reconstruction of Msuzi Bridge which was washed away recently.

Early this month Infrastructure and Housing permanent secretary Charles Mushota informed Paramount Chief Mpezeni that a team of engineers from Japan was in the country to look at Luangwa Bridge which needs replacement.

“We have a team of technical people, engineers from Japan who have come to look at the Luangwa Bridge. As you are aware your royal highness that bridge is very old and needs replacement like yesterday and government desires that that bridge is worked on as quickly as possible so that it doesn’t hamper in future the movement of the people in and out of the province to Lusaka,” Mushota said.

State Re-Opens K2 Million Theft Case by 2 Lawyers

The state have taken back the matter to the subordinate court in which two lawyers and a former accounts manager at LAICO Zambia Limited were acquitted for theft of K2 million.

Justice Sharon Newa dismissed the application by the state on account that the action they sought did not conform to the provisions of section 341 and 350 of the Criminal Procedure Code.

The state wanted an opinion on the matter involving two lawyers Jeah Madaika and Mwila Chibiliti who were jointly charged with former accounts manager at LAICO-Zambia Clement Wonani for theft of K2 million but were acquitted by the Lusaka Magistrate Court.

In dismissing the state’s case Justice Newa directed that the case be taken back to the Subordinate Court for amendment of the questions on the opinion they sought from the court.

The state was given seven days to amend their questions so that they reflect that they are being made pursuant to the court’s findings either by being erroneous on points of law or being in excess of jurisdiction.

The state has since made an amendment pursuant to section 347 of the Criminal Procedural code which they have filed before the Lusaka Magistrate Court.

The state is contending that the Magistrate erred at law when he delved into analysing issues of new and old management and company law procedures which is beyond his jurisdiction abandoning the offence of theft in his ruling.

In acquitting them Magistrate Malumani said Madaika and Chibiliti were being paid money for legal services they had offered to LAICO-Zambia.

The court said at the time when Wonani directed the moving of the K2 million from LAICO-Zambia accounts to J & M Advocates, he was still an employee of the company and there was a letter to that effect which the police did not tender in court because they knew that it would work to the advantage of the accused.

Magistrate Malumani said since Wonani was finance manager at LAICO-Zambia at the time, he had the right to direct for the movement of money from the company account for purposes of paying the lawyers for their services.

And magistrate Malumani said the Zambia police who investigated the matter had no jurisdiction in an issue bordering on corporate management.

He also said Madaika, Chibiliti and Wonani had no intentions to permanently deprive LAICO-Zambia of its money because they had worked for it and were entitled to payment.

Government has fired Zambia Consolidated Copper Mines-Investment Holdings Chief Executive Officer Pious Kasolo.

Mines Minister Richard Musukwa announced the development at a press briefing at State House.

Musukwa jointly addressed the press with State House spokesperson Amos Chanda.

Kasolo had set himself on a coalition path with government with his anti-new mining tax regime stance.

Kasolo recently told a media briefing that the 2019 planned mining taxes would impact negatively on ZCCM-IH which holds shares on behalf of the Government in the mining companies.

Addressing the media on Monday 28th January, Dr. Kasolo said that the new taxes would affect investments and production of the mines, hence the need to resolve issues as this could have an impact effect on dividends paid to the holding company.

“At the moment, taxes have not come to fruition but by projection the move will affect ZCCM-IH because we get dividends from the companies,” he said.

Dr Kasolo is widely viewed as leaning toward the mining firms that have been fighting the new tax regime.
