Sean Tembo to Withdraw Eswatini Land Case Against Pres. Lungu

Patriots for Economic Progress (PeP) leader Sean Tembo intends to withdraw the matter in which he sued the Attorney General Likando Kalaluka in the Constitutional Court and seeks a declaration that President Edgar Lungu violated the constitution by accepting the Eswatini land as a gift without declaring it to the state.

Tembo has disclosed that he will file a notice of discontinuation of the matter before Friday (14th December, 2018).

The PeP president said that his decision to discontinue the case was motivated by the spirit of national dialogue going on in the country.

Tembo has not had a smooth ride in his case having failed in his application to subpoena State House spokesperson Amos Chanda and Information Minister Dora Siliya to testify in the case.

He had sought the court’s interpretation of whether or not President Lungu breached the constitution when he accepted a piece of land in Eswatini without declaring it to the nation.

Tembo had asked the court to compel Chanda and Siliya and two journalists Oliver Chisenga (The Mast) and Steven Mvula (Daily Mail) to testify but his application was dismissed on November 29, 2018.

The plaintiff later filed for a notice for leave to appeal to the full bench following the Constitutional Court judgment which threw out his application to subpoena state witnesses to testify in the case.
