Supreme Court Rules Mutembo Nchito Tribunal Must Resume

Muetmbo Nchito during parliamentary committee sittingSuspended Director of Public Prosecution Mutembo Nchito will have to live with the reality of facing the tribunal after the Supreme Court thwarted the stay granted to him by the High Court.

Nchito was last March suspended by President Edgar Lungu with a tribunal constituted against him over a myriad of abuse of authority charges.

Nchito took the matter to the High Court challenging the validity of the tribunal and also sought to have two of the three tribunal members Mathews Ngulube and Earnest Sakala removed from the panel.

He was granted judicial review by the Lusaka High Court but the state appealed the decision in the Supreme Court.

Chief Justice Ireen Mambilima ruled that the High Court erred by granting Nchito a stay of execution and ordered the tribunal be re-convened.

Nchito is among other charges accused of having illegally entered into nolle prosequis in cases he had interests in, illegally contracting a debt he knew he had no capacity to pay and also failure to declare interest in some of the cases he had a direct interest in.

The former DPP benefitted heavily under late President Michael Sata who was remote controlled by the infamous cartel whose other members are Post Newspapers Editor Fred M’membe, his acolyte Wynter Kabimba and the Indian-Canadian businessman Rajan Mahtani.
