Rupiah_Banda_Mandevu_4Dec2014The call for the reinstatement of former President Rupiah Banda’s immunity has repeatedly surfaced in parliament with the Speaker of the National Assembly Patrick Matibini dodgy on the matter.

On Tuesday on the opening day of parliament Chadiza lawmaker Allan Mbewe raised the matter with Matibini skirting around the subject but the matter was back this afternoon with Chipata Central legislator Mtolo Phiri following up the matter through a point of order.

The Chipata Central lawmaker gave a sequence of events in the Rupiah Banda case started with the removal of immunity on 1st March 2013 and culminated into an acquittal on July1 2015.

Phiri said the new constitution article 98 (10) guided that a former President whose immunity has been removed but is found not guilty should have his immunity re-instated.

“Is the Minister of Justice in order to remain silent when the matter has caused anxiety among some citizens,” he said.

Matibini responded: “…If there are any anxieties in any quarters they should be put to rest by letting you raise the matter in a state of law. If the people on the right (government) are inclined to give an explanation to the public I will give them a chance to give a statement.”
